Thank you for choosing VPSimple. By using our products, services and sites you agree to the following terms, conditions, policies, guidelines or amendments thereto known as the Terms of Service.
VPSimple reserves the right to modify the Terms of Service without notice.

SLA - Service Level Agreement

Il servizio di Outsourcing offerto da VPSimple viene garantito nelle sue componenti secondo le seguenti percentuali di servizio, calcolate su base annua :
− Raggiungibilità dei Server VPSimple pari al 99,80%.
− Disponibilità dei servizi VPSimple d’ambiente pari al 99,90%.
− Presa in carico di problemi dal supporto clienti : immediato
− Intervento sui servizi VPSimple entro un tempo massimo di 1 ora lavorativa
− Intervento sui Server all’interno della server farm entro un tempo massimo di 2 ore lavorative

Il Service Level Agreement non è valido nel caso in cui si verifichi uno dei seguenti eventi:
− Danneggiamento dell'infrastruttura da parte del cliente o da software da lui installati.
− Malfunzionamenti, danneggiamenti o disservizi derivanti da terzi o, comunque, non imputabili a VPSimple.
− Nel caso di guasti o problemi esterni alla rete di VPSimple o per cause di forza maggiore o caso fortuito (a titolo esemplificativo ma non esaustivo: guasti al collegamento internet utilizzato dal Cliente per collegarsi al server oppure guasti dei carrier che forniscono la connettività a VPSimple).

Gli interventi di manutenzione ordinaria che comportano un fermo della macchina sono comunicati al Cliente con un preavviso di almeno 24 ore e non rientrano nell'ambito di applicazione delle penali stabilite dal presente SLA La penale che VPSimple verserà al Cliente nei soli casi di downtime previsti ammonta al 5% del canone totale per ogni 4 ore di downtime superiore allo 0.2% su base annua. Tale importo verrà liquidato da VPSimple entro la fine del primo mese successivo all'annualità contrattuale a mezzo di nota di credito. Nel caso di molteplici guasti la somma massima rimborsabile da parte di VPSimple ammonta al 20% del canone annuale totale.
Resta, naturalmente, inteso che con l'accettazione del presente SLA il Cliente rinuncia a qualsiasi ulteriore pretesa e/o richiesta di rimborso, di risarcimento danni e/o rescissione del contratto.

Use of VPSimple Products and Services

You may use any of our services, provided that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Italy or other jurisdictions.
In order to access certain services, you are required to provide current and accurate identification, contact, and other information as part of the registration process.
You are responsible for maintaining the confidentiality of your account information, and are responsible for all activities that occur under your account. You are solely responsible for all content on your account, your VPS(s) and all their content.
You agree to immediately notify VPSimple of any unauthorized use of your account or any other breach of security. VPSimple will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep your account secure.

Acceptable Conduct

You agree that you are responsible for maintaining your own account. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, files, attachments or other materials ('Content') are the sole responsibility of the account from which such Content originated.
VPSimple reserves the right, but does not assume the responsibility, to monitor or review any Content on VPSimple services.
You agree that you are responsible for the conduct of all users of your account and any Content that is created, transmitted, stored, or displayed by, from, or within your account while using VPSimple services and for any consequences thereof.
You agree to use VPSimple services only for purposes that are legal, proper and in accordance with the Terms of Service and any applicable policies or guidelines. You agree that you will not engage in any activity that interferes with or disrupts VPSimple services or servers or networks connected to VPSimple services.

Prohibited Usage

You agree that any of the below activities are considered prohibited usage and will result in immediate account suspension or cancellation without a refund and the possibility that VPSimple will impose fees; and/or pursue civil remedies without providing advance notice.
Misuse of System Resources: Misuse of system resources, including but not limited to employing programs that consume excessive CPU time (outside of reserved CPU slice), network capacity, disk IO or storage space.
Unsolicited Communications: Sending unsolicited bulk messages utilizing our network. Generating a significantly higher volume of outgoing e-mail than a normal user. Using a non-existent email return address. Open E-mail relaying. Sending out unsolicited email from any other network that points to a VPSimple server.
Access to Other Computers or Networks without Authorization: Attempting unauthorized and/or illegal access of computers, networks and/or accounts not belonging to party seeking access. Any act which interferes with the services of another user or network. Any act relating to the circumvention of security measures.
Other Activities viewed as Illegal or Harmful: Engaging in illegal activities or engaging in activities harmful to the operations of VPSimple or the customer.
Providing False Data on any Contract or Application: including fraudulent use of credit card numbers.
Non utilizzare o far utilizzare a terzi, direttamente o indirettamente, il Servizio in violazione della vigente normativa, della morale e/o dell�ordine pubblico, al fine di turbare la quiete pubblica o privata, di recare offesa, danno diretto o indiretto a chiunque, compreso se stesso (a titolo esemplificativo ma non esaustivo: � vietato l'inserimento nello spazio web di dialer o di materiali o estratti di materiale che trattano pedofilia o apologie razzistiche o fanatiche, mentre materiale a carattere pornografico potr� eventualmente essere inserito soltanto nel rispetto delle normative vigenti in materia es. in apposite aree riservate create dal titolare del sito accessibili esclusivamente alle persone maggiorenni tramite apposita password rilasciata dal titolare del sito dopo accurata verifica compiuta sulla maggiore et� del richiedente), o comunque al fine di violare contravvenire o far contravvenire in modo diretto o indiretto alle vigenti leggi dello Stato italiano o comunque in modo tale da recare danno o nuocere, in qualsiasi modo e forma, all'immagine ed ai marchi di propriet� di VPSimple.

Account Cancellation or Suspension

VPSimple may cancel or suspend your access to VPSimple services at any time and for any reason without notice.
Upon cancellation or suspension, your right to use the service will stop immediately. You may not have access to data that you stored on the service after we suspend or terminate the service. You are responsible for backing-up your data that you use with the service. If we cancel your service in its entirety without cause, we will refund to you on a pro-rata basis the amount of your payment corresponding to the portion of your service remaining right before we terminated your service.
You may delete your VPS at any time by following the instructions in the Management Portal. As soon as you delete your VPS(s) your right to use it stops immediately. You will not have access to data that you stored on the VPS after you delete it. You are responsible for backing-up your data.
Cancellation of the service by you will not alter your obligations to pay all charges due to VPSimple at the time of cancellation.
